In fact, there is no record of Briant HARTGILL again. It is circumstantial evidence that suggests that Briant and Ann were the parents of John HARTGILL alias OWEN. At this time (prior to 1754) all that was required for a legal marriage was the consent of both parties and evidence of consummation, and of course a baby was evidence. So if John HARTGILL alias OWEN was born of these parents, he would have been considered by some as legitimate, but by others as illegitimate, since church marriage was certainly the norm and the preferred method of marraige.

Will gist: John HARTGILL of Stourton, yeoman. To son John HARTGILL his messuage and house in Zeals, now in the occupation of William ROACH taylor; also messuage and house in Zeals next door to the one occupied by William Roach and now occupied the said son John; also all his dwelling houses in Marnhull, Dorset and now in the occupation of Peter HARDING, carpenter. To daughter Elizabeth HARTGILL, three messsuages and dwelling houses in Zeals now in the occupation of John HARROLD, John SHEPHERD and David STONE. Also to Elizabeth the house, workshops, orchards and land in Stourton. Everything else to Elizabeth. If Elizabeth has no descendents, then it all reverts to John. Dated 16 Nov 1815.
